This Privacy Statement applies to your personal information collected or processed by WHP Plus, LLC (owner of the Anne Klein® and associated intellectual property rights) and its affiliated entities (collectively, “WHP,” “we,” “us” or “our”) through its applications, platforms, services, or other resources related to, distributed on, or available through this website where this Privacy Statement is located or referenced (collectively, this “Site”).  Please read this Privacy Statement carefully to understand our policies and practices regarding your personal information and how we will treat it.

This Privacy Statement may change from time to time. We will notify you of changes by posting an updated copy to the Site, or by notifying you of material changes to this Privacy Statement by posting a notice on our home page for a reasonable period of time and changing the “Last Updated” date above. So please check it periodically for updates.

  1. WHAT CATEGORIES AND SPECIFIC PIECES OF PERSONAL INFORMATION DO WE COLLECT AND PROCESS?

We (and the vendors and other parties we use to perform services on our behalf) may collect or process various categories and specific pieces of personal information, including the following in the last 12 months:

    1. Contact Information and Other Identifiers

We collect contact information and other identifiers, which may include names, shipping addresses, dates of birth, telephone numbers, social media account handles, and e-mail addresses such as when you provide them to us during online registration, when placing an order, or when doing business with us. The Site may allow you to establish a username and password to set up an account and to provide security questions and answers in connection with your account.

Contact information and other identifiers are sourced directly from you or from third party providers, such as data brokers or social media platforms. They are used to provide and improve the features, products and services you request; for registration and promotions; to communicate with you and provide you with information; to provide you with personalized content, information, and to send you coupons, offers and other information on our products or our family of companies; when we perform our obligations under a contract with you; and to deliver relevant advertising; and/or for research purposes.

    1. Commercial, Customer Records, and Preference Information

We may collect payment card and other payment details if you make a purchase. We may also collect information about your purchase history and preferences. This information is generally sourced directly from you when you call, email, place an order for products or services, or otherwise communicate with WHP. This information is used to provide and improve the features, products and services you request; to provide you with personalized content, information, and to send you coupons, offers, and other information on our products or our family of companies; when we perform our obligations under a contract with you.

    1. Device, Internet, and Network Activity

For example, we may collect Internet Protocol (IP) address or device identifier, your Internet service provider, your device’s operating system, browser type, websites visited before or after you visit our website, pages viewed and activities at our website, as well as your interaction with advertisements. We or our vendors may also collect and record page interaction information and other electronic communications and content from your use of the Site (such as content entry, mouse movements, online chats, screen captures, the date, time, and location of your visit, what areas of the websites you visit and for how long, what search terms or other data you enter, and what products or content or links you view and click on), and methods used to browse away from the page.  We or our vendors may also embed technologies (which may include, for example, web beacons, tags, and pixels) in the emails and other communications we or our vendors send to you to help us understand how you interact with those messages, such as whether and when you opened a message or clicked on any content within the message. We may engage or otherwise permit other parties to also collect this information. Third-party service and advertising partners may also collect information automatically.

Device, internet, and network activity is generally sourced indirectly from you (e.g., from observing your actions on this Site) or from third party service providers, such as a data analytics provider. This information may be used to provide you with personalized content, information, and to send you coupons, offers, and other information, and/or to deliver relevant advertising. This information may also be used for analytics and to help us update, develop, and improve the Site and our products, services, and advertising. 

    1. Geolocation Information

Geolocation information is sourced from your devices and from the information you submit or provide. Geolocation information may be used to provide you with personalized content, information, and to send you coupons, offers, and other information on our products or our family of companies, and/or to deliver relevant advertising.

    1. Employment Information

If you apply for a job, we will collect information submitted to us to indicate your interest in a position, including your indicated job preferences, work history and information provided on job applications.

Professional or employment-related information is sourced directly from you or from third party service providers (i.e., background check provider). This information is used to process employment applications and when we perform our obligations under a contract with you.

    1. Inferences

Using other pieces of personal information collected about you, we may draw inferences about you. Inferences drawn from other personal information is sourced indirectly from you (e.g., from observing your actions on this Site) or from third party service providers, such as a data analytics provider. Inferences are used to provide and improve the features, products and services you request; to provide you with personalized content, information, and to send you coupons, offers, and other information on our products or our family of companies, and/or to deliver relevant advertising.

    1. Information You Submit, Provide, or Post

For example, we collect information you submit on this Site and our social media pages.  We also collect information when you interact with us, such as comments, use of our chat features, photos, or other information that you post, through blogs, message boards, or social networking opportunities or other interactive forums.

  1. Information From Third Party Sources

We may collect information from other sources, including contact lists, and demographic information from third parties and other sources. This data may be combined with other information that we collect and use for the purposes described in this Privacy Statement.

We might use your information to serve you ads about products, services and offers we think might interest you. We might tell you about new features or updates. These might be third party offers or products we think you might find interesting. Sometimes our brands will make offers, coupons and information, including catalogues, available to you through the mail. We also may use demographic and preference information to allow advertising related to WHP products and services to be targeted to the users for whom they are most pertinent. This is designed so that users will see advertising that is most likely to interest them, and advertisers can display their ads to people who are most likely to be receptive.

We may use the personal information that we collect to improve the WHP family of product offerings, services, as well as this Site and features. We might use your information to customize your experience with us and to conduct research and analysis.

We will use certain pieces of information to verify your identity if you make requests pursuant to this Privacy Statement. The verification steps and the pieces of personal information that we request may vary depending on the sensitivity and nature of your request.

To the extent permitted by applicable law, we may use the personal information we collect for serving online advertising, and/or generating a profile for you.

    1. When you engage with WHP content through third-party social networking sites

WHP may offer social networking opportunities where personal information may be posted and collected by WHP. Be sure to check posted rules before entering the particular site. Anything you post online is public information, and we are not responsible for anything you voluntarily post online.

  1. Contact a WHP customer service or sales representative

When you contact a WHP customer service or sales representative, personal information  used to fulfill your particular inquiry may be requested. Such personal information may also be used to track a claim, open a problem report, or other administrative process that requires personally identifying you.

We use information as otherwise permitted by law or as we may notify you from time to time.

  1. HOW DO WE SHARE AND DISCLOSE YOUR INFORMATION?

We may share or disclose your personal information:

  1. With the WHP family of companies and our parent, subsidiaries, and affiliates.
  2. With WHP’ licensees, retailers that offer goods and/or services branded under marks owned by WHP, or other WHP’ business partners.
  3. With vendors or agents. For example, we may share your personal information with companies we have hired to provide services on our behalf.
  4. Where your personal information may be transferred along with other business assets.
  5. Where we have received your direction or consent to the disclosure of your personal information.
  6. To comply with the law or respond to legal process or lawful requests, including from law enforcement and government agencies.
  7. To conduct investigations of consumer complaints or possible breaches of law, to protect the integrity of the Site, to fulfill your requests, or to cooperate in any legal investigation.
  8. To protect the rights or property of the WHP family of companies, our customers or others, including enforcing the terms governing your use of the services.

  11. To other parties for their marketing purposes. These parties may include our retail partners, co-sponsors, social media platforms, advertising networks, and ad tech companies. They may also include other parties in whose products or services we believe you may be interested. These parties may also disclose your information to others. These parties may use the information for their own marketing purposes or the marketing purposes of others. This may include the delivery of interest-based advertising. These parties may also send you information about events or products by mail or email.

  13. We may share anonymized or de-identified information we collect under any of the above circumstances. We may also share it with third parties to develop and deliver targeted advertising on this Site, and on websites of third parties. We may combine anonymized or de-identified information we collect with additional anonymized or de-identified information collected from other sources. We also may share aggregated and anonymized information with third parties, including advisors, advertisers, and investors, for the purpose of conducting general business analysis. For example, we may tell our advertisers the number of visitors to our website and the most popular features or services accessed.
  1. WHAT ABOUT CHILDREN’S PRIVACY?

The Site is intended for adults over the age of 18. The Site does not knowingly solicit or collect personally identifiable information online from children under the age of 18.  If you become aware that a child under 18 has registered for our email newsletters, or otherwise provided us with their personal information, please report the use by emailing us at the contact information in Section 11. If we become aware of a user under the age of 18 providing information on this Site, our policy is to terminate that account and purge our databases of personal information provided by that user to the extent feasible.

  1. COOKIE NOTICE AND OUR POLICIES REGARDING ONLINE INTEREST-BASED ADVERTISING

“Cookies” are data files that a website sends to your computer while you are viewing the site. These data files include information that allows this Site to remember important information that are designed to make your use of this Site more efficient and useful to you. The Site uses cookies for a variety of purposes. Cookie technology helps us deliver content tailored to a visitor’s interests, and allows us to make ordering products, entering and participating in sweepstakes and contests, and offering other functions at our sites easier for our visitors. How do we serve advertisements through online interest-based advertising?
At times we display ads both on our network of owned and operated websites and on the websites of third parties. We and our third-party advertising partners use this Online Data to paint a more accurate picture of the interests of the audiences with which we interact – including you – so that we can serve ads that are more relevant to those interests. In addition, our advertising partners use this Online Data for a variety of other purposes, including (a) in conjunction with advertising that appears on our website or other websites, (b) for reporting website traffic, statistics, advertisement data and other interaction with ads and the websites on which they are served, and (c) to measure the effectiveness of web-based and e-mail advertisements.

How can you opt-out of receiving interest-based ads from us?

If you are no longer interested in receiving interest-based ads from this Site, you can opt-out by using the instructions below. Please note, however, that opting-out does not mean you will no longer see ads from us. It simply means that the ads from us you do see will not be based on your particular interests.

You can control certain cookies and tracking tools. You can opt out of certain uses of cookies for advertising purposes by visiting this site: Ad Choices. You can also consult the user instructions for your Internet browser for additional controls relating to the use of cookies, including blocking certain cookies by adjusting the settings on your Internet browser.

You can also generally opt-out of receiving certain interest-based ads from third party advertisers who are members of the Network Advertising Initiative (“NAI”)or who follow the DAA Self-Regulatory Principles for Online Behavioral Advertising by visiting the opt-out pages on the NAI website and DAA website.

When you opt-out using these methods, a cookie will be placed on your device indicating that you have opted-out of certain interest-based advertising. Choices you make regarding cookies are website, device, and browser specific. This means you need to adjust your cookie preferences on each website, device, and browser you use. If you delete or block your cookies, you will need to opt-out again and you will not be able to use all of the features of our Sites, including the customization features associated with creating a user profile. These websites also provide detailed information about interest-based advertising and tips for managing your online privacy.

Different types of cookies used by us, include

    • Strictly Necessary cookies let you move around the website and use essential features.
    • Performance cookies collect information about how you use our website, e.g., which pages you visit, and if you experience any errors.
    • Functional cookies are used to provide services or to remember settings to improve your visit.
    • Targeting cookies are linked to services provided by third parties, such as 'Like' buttons and 'Share' buttons. The third party provides these services in return for recognizing that you have visited our website.

What are web beacons and how do we use them?

Some of our Web pages and e-mail updates may contain electronic images called Web beacons, sometimes known as one pixel GIFs, clear GIFs or pixel tags. On sites, these allow us to count visitors who have viewed our pages. In promotional e-mail messages/newsletters, they allow us to count how many subscribers have read them. Web beacons allow us to develop statistical information about the activities and features that most interest our consumers for the purpose of providing more personalized content.

How We Respond to Do-Not-Track Disclosures

We do not support “Do Not Track” browser settings and do not currently respond to such signals.

Employment opportunity related queries may also be transferred to any member of the WHP family of companies. By visiting this Site and submitting information, you consent to such collection, processing, transfer and/or storage of any personal information that you submit. Please note: our policies may differ by region, so if you visit one of our websites in a different region, please check to see if there is a Statement specific to that location.

    1. How long do we store your personal information?

We retain and store your personal information for as long as we have a legitimate business purpose to do so and in accordance with our data retention policies. We also keep information as otherwise required or permitted by law.

We may offer chat rooms, message or bulletin boards, or interactive areas where visitors may post comments or information for our visitors’ enjoyment. If there is a chat room, bulletin or message board, social networking opportunities or other interactive areas where personal information may be posted at this website, be sure to check posted rules before entering, as you will be bound by them as well as our Terms of Service. Anything you post online is public information, and we are not responsible for anything you voluntarily post online. Users should exercise caution when disclosing personal information online.

      In the event that all or part of our assets are sold or acquired by another party, or in the event of a merger, you grant us the right to assign the personal information we have collected from you.
    2. Opting-out of receiving our marketing emails and text messages

To stop receiving our promotion emails, you can follow the instructions in any promotional message you receive from us. If you receive promotional text messages from us, you may opt-out by replying “STOP”. After you send the message “STOP” to us, we will send you a reply message to confirm that you have been unsubscribed. Even if you opt out of getting marketing messages, we may still send you certain transactional messages. These include responses to your questions.

    1. How do we safeguard your personal information?

We have implemented administrative, physical and technical safeguards designed to help protect your personal information. No security measures can be 100% secure, however, and so we recommend that you take additional measures to protect yourself and your personal information, including by installing up to date anti-virus software, closing browsers after use, keeping confidential your log-in credentials and passwords, and making sure that you regularly update software and apps you have downloaded to ensure you have enabled the latest security features on your devices.

We may collect, use, and disclose for our business and commercial purposes, categories of personal information as set forth in applicable California law, including: Identifiers; payment and customer records information; characteristics of protected classifications under California or federal law (such as demographic information like age and gender); commercial information; professional or employment information; internet or other electronic network activity information; geolocation data; education information; audio, electronic, visual, or similar information; and inferences. We may collect categories of sensitive personal information as set forth in applicable California law, including account login credentials when combined with passwords. We collect and use the above categories of personal information for the business and commercial purposes described in Section 3 of this Privacy Statement.

We collect these categories of personal information from the sources described in Section 2 above.

We may disclose each of the foregoing categories of personal information for the business and commercial purposes described in Section 3 of this Privacy Statement to the extent permitted by applicable law to the categories of parties as described in Section 4 of this Privacy Statement.

We may “sell” or “share” categories of personal information, including: identifiers; internet or other electronic network activity information; geolocation information; and inferences. We may “sell” or “share” these categories of personal information to the categories of third parties described in Section 4 of this Privacy Statement for the purposes described in Section 3 of this Privacy Statement.

We retain and store your personal information for as long as we have a legitimate business purpose to do so and in accordance with our data retention policies. We also keep information as otherwise required or permitted by law.

From time to time, we may collect personal information in connection with a promotion, offer, program, or discount. The offers and incentives made available through them are generally related to the value of the relationships that we have with the individuals who participate. Participation is voluntary and you may withdraw at any time by emailing us using our contact information below.

California law affords residents of California certain rights, including:

  • Access: You have the right to request that we disclose to you the categories of personal information we collected about you; the categories of sources for the personal information we collected about you; the categories of personal information we sold, shared, or disclosed; our business or commercial purpose for collecting, selling or sharing that personal information; the categories of third parties with whom we disclosed that personal information; and the specific pieces of personal information we collected about you over the past 12 months.
  • Do Not Sell or Share My Personal Information: You have the right to opt out of the “sale” or “sharing” of your personal information. For purposes of this Section, “sale” means the sale of your personal information to an outside party for monetary or other valuable consideration, and “share” means the disclosure of your personal information for cross-context behavioral advertising purposes, subject to certain exceptions set forth in applicable California law. Note that there may be restrictions regarding the number of times you can exercise these rights. We may deny certain requests, or fulfill a request only in part, based on our legal rights and obligations. For example, we may retain personal information as permitted by law, such as for tax or other record keeping purposes, to maintain an active account, and to process transactions and facilitate customer requests.

We will take reasonable steps to verify your identity prior to responding to certain of your requests. The verification steps will vary depending on the sensitivity of the personal information and whether you have an account with us. You may designate an authorized agent to make a request on your behalf. However, you must provide the agent written permission authorizing the agent to submit the request on your behalf. The agent must also verify their identity with us directly before we will provide your information, unless prohibited by applicable law.

We may deny a request from an agent that does not submit proof that they have been authorized by you to act on your behalf.

California residents may also request once each year if we have disclosed their personal information to third parties for their direct marketing purposes.   1. WHAT ARE YOUR COLORADO, CONNECTICUT, AND VIRGINIA PRIVACY RIGHTS?

This Section supplements the information contained in this Privacy Statement and applies solely to residents of Colorado, Connecticut, or Virginia. If you are a resident of Colorado, Connecticut, or Virginia, you may make the following requests with respect to your personal information in accordance with applicable law:

  • Confirmation/Access:You can request to confirm whether we process your personal information. Subject to certain exceptions, you can also request a copy of your personal information.
  • Deletion:You can request that we delete your personal information.
  • Correction:You can request that we correct inaccurate personal information we maintain about you.
  • Opt-Out of Targeted Advertising:We may use personal information obtained from or in connection with your activities across unaffiliated sites to send more relevant advertising to you. You can request that we stop using your personal information for such targeted advertising.
  • Opt-Out of Sale: You can request to opt-out of the “sale” (as defined in applicable state law) of your personal information to a third party.

We may “sell” or process for targeted advertising certain of the categories of personal information including: identifiers; internet or other electronic network activity information; geolocation information; and inferences.  We may “sell” these categories of personal information to or with the categories of third parties described in Section 4 of this Privacy Statement. For purposes of this paragraph, “sell” means the sale of your personal information to a third party for monetary or other valuable consideration, subject to certain exceptions set forth in applicable Colorado or Connecticut law. Note that for purposes of these requests under this Section, personal information does not include information about job applicants, employees and other of our personnel; information about employees and other representatives of third-party entities we may interact with; or information we have collected as a service provider.

If you are a resident of Colorado or Connecticut, you may designate an agent to submit an Opt-out of Sale or Opt-out of Targeted Advertising request on your behalf. Proof to verify your identity and the authorized agent’s authority to submit requests on your behalf is required, or we may deny the request. 

From time to time, we or our vendors on our behalf may collect personal information in connection with a promotion, offer, program, discount or other benefits.
